Welcome to She-Rise Collections, LLC (“She-Rise Collections,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your use of our website, customer accounts, physical products, custom products, digital products, downloadable content, AI generators, web-based tools, memberships, subscriptions, and other services offered by She-Rise Collections, LLC.

By accessing our website, creating an account, placing an order, beginning a free trial, purchasing a membership, downloading a digital product, or using one of our services, you agree to these Terms and any additional policies or product-specific terms that apply to your purchase.

If you do not agree to these Terms, please do not use our website or purchase or access our products or services.

1. OUR STORE AND PRODUCTS

She-Rise Collections, LLC offers a variety of products and services that may include:

PNG and other image files

Each product listing is intended to identify the type of product being offered and the applicable delivery or access method.

Customers are responsible for reviewing the product description, requirements, pricing, purchase options, and applicable policies before completing a purchase.

2. ELIGIBILITY

By using our website or purchasing from us, you represent that you are legally permitted to enter into transactions and agreements in your jurisdiction.

If you are not legally able to enter into a binding agreement on your own behalf, you may only use our services with appropriate authorization.

Our website and the SRC Lupus Wellness Tracker™ are not directed to children under 13.

3. CUSTOMER ACCOUNTS

Certain products and services require a She-Rise Collections customer account.

You are responsible for:

Providing accurate account information
Maintaining access to the email address associated with your account
Protecting your login credentials
Preventing unauthorized use of your account
Promptly notifying us of suspected unauthorized account access

You may not intentionally impersonate another person, create accounts for fraudulent purposes, or use another customer's account without authorization.

We may take reasonable steps to protect accounts, purchases, memberships, and digital access from fraud or unauthorized use.

4. ORDERS

Submitting an order does not necessarily guarantee acceptance.

We reserve the right, where permitted by law, to:

Refuse or cancel fraudulent or suspicious orders
Limit quantities
Correct pricing or listing errors
Request additional information to verify an order
Cancel an order when a product is unavailable
Correct obvious technical errors

If we cancel an order after payment has already been collected, any amount properly owed back to the customer will be handled according to the applicable refund procedures and law.

5. PRICING AND PAYMENT

Prices are displayed in the currency shown on the website or during checkout.

Prices, products, membership offerings, discounts, and promotions may change from time to time.

The price displayed and agreed to at checkout generally applies to that transaction, subject to correction of obvious errors and applicable law.

Payments may be processed by Shopify Payments or other third-party payment processors.

She-Rise Collections, LLC does not directly store complete payment-card information on its own servers.

Applicable taxes may be collected when required.

6. PHYSICAL PRODUCTS

Physical products will be identified as such in the applicable product listing.

Processing and delivery estimates are estimates and may be affected by production times, carrier delays, weather, holidays, inventory availability, or other circumstances outside our reasonable control.

Returns, exchanges, cancellations, damaged-item claims, and refunds for physical merchandise are governed by our Return and Refund Policy and applicable Shopify return rules.

7. CUSTOM, PERSONALIZED AND MADE-TO-ORDER PRODUCTS

Products created specifically for a customer may include personalized names, photographs, wording, colors, designs, sizes, specifications, or other requested elements.

Because these items are created specifically for the customer, they may be final sale as described in our Return and Refund Policy.

Customers are responsible for reviewing personalization information carefully before submitting an order.

8. DIGITAL PRODUCTS

Digital products may include:

PNG files
JPG files
SVG files
PDFs
ZIP files
Digital artwork
Templates
Ebooks
Printable products
Prompt systems
Digital planners
Design resources
Other electronically delivered materials

Unless the product description specifically states otherwise, purchasing a digital product does not mean that a physical product will be shipped.

Customers are responsible for having any software, devices, applications, subscriptions, or technical knowledge identified as necessary in the applicable product listing.

9. DIGITAL PRODUCT LICENSES

Purchasing a digital product gives you only the usage rights specifically provided in the applicable product description, license, or terms.

Ownership of the underlying copyright or intellectual property does not transfer to the purchaser unless expressly stated in writing.

Some She-Rise Collections products may include commercial-use rights.

Commercial-use permission applies only when expressly stated for the specific product and remains subject to any limitations contained in the applicable license.

Unless expressly authorized, customers may not:

Resell original digital files
Redistribute source files
Share purchased files with others
Upload purchased files for unauthorized distribution
Repackage our products for resale
Claim our original work as their own
Sell access to our proprietary generators or systems
Copy or reproduce our proprietary prompt systems for redistribution
Circumvent digital-access restrictions

10. AI GENERATORS AND INTERACTIVE DIGITAL TOOLS

Certain She-Rise Collections products provide access to AI generators, prompt generators, interactive design tools, creator studios, web-based tools, or similar digital systems.

These products may rely on third-party platforms or services.

Depending on the product, use may require services such as:

Canva
ChatGPT/OpenAI
Compatible AI-generation platforms
Internet access
A compatible browser
Third-party accounts
Paid third-party subscriptions

Requirements will be identified in the applicable product description when relevant.

She-Rise Collections does not control third-party platforms and cannot guarantee their continued availability, pricing, features, output, compatibility, policies, or performance.

11. AI-GENERATED OUTPUT

AI-generated results may vary.

We do not guarantee that a third-party AI platform will reproduce an exact design, character, image, layout, typography treatment, or result every time.

Customers are responsible for reviewing generated content before using, publishing, selling, or distributing it.

Customers are also responsible for ensuring that their use of generated content complies with applicable law and the terms of the AI platform they choose to use.

12. SRC LUPUS WELLNESS TRACKER™ MEMBERSHIP

The SRC Lupus Wellness Tracker™ is a private, web-based interactive consumer wellness application provided through a recurring membership.

It is:

Not a physical product
Not a downloadable PDF
Not a printable planner
Not a downloadable application
Not an App Store or Google Play application

Members access the tracker through their She-Rise Collections customer account using the email address associated with the membership purchase.

A compatible device, browser, and internet connection are required.

13. 7-DAY FREE TRIAL

Eligible Monthly and Annual SRC Lupus Wellness Tracker™ memberships begin with a 7-Day Free Trial.

A valid payment method is required to begin the trial.

Unless canceled before the trial expires, the membership will automatically convert to the paid membership selected at checkout and the payment method on file will be charged according to the displayed billing schedule.

Current membership pricing and billing frequency are displayed before checkout.

14. FREE-TRIAL CANCELLATION

Members may cancel during the 7-day free trial.

When cancellation is completed before the trial expires:

The upcoming paid membership renewal is canceled.
The customer will not be charged for that upcoming renewal.
Tracker access remains available through the remainder of the free-trial period.
Tracker access ends when the applicable trial-access period expires.

Canceling during the trial does not immediately remove the remaining free-trial access.

15. AUTOMATIC MEMBERSHIP RENEWAL

After the free trial, an active membership automatically renews according to the selected Monthly or Annual billing schedule until canceled.

By starting a recurring membership, you authorize the applicable payment processor to charge your payment method according to the membership terms displayed during enrollment.

16. CANCELING A PAID MEMBERSHIP

Members may manage or cancel an eligible recurring membership through their She-Rise Collections customer account.

Cancellation stops future eligible automatic renewals.

If a paid billing period has already begun, access may continue through the remainder of that applicable paid period.

Canceling does not automatically create a refund for a charge that has already been successfully processed.

Additional membership cancellation terms are contained in our Purchase Options Cancellation Policy.

17. FAILED MEMBERSHIP PAYMENTS

If a recurring payment fails, additional payment attempts may be made according to our membership-payment settings.

Customers may be asked to update their payment method.

If payment remains unsuccessful after the applicable retry period, membership access may be canceled or terminated.

18. WELLNESS AND MEDICAL DISCLAIMER

The SRC Lupus Wellness Tracker™ and any other wellness-related content or tools offered by She-Rise Collections are intended for:

Personal wellness tracking
Organization
Recordkeeping
Informational purposes

They are not medical services.

Nothing provided through the tracker or our website constitutes:

Medical advice
Medical diagnosis
Treatment
Treatment recommendations
Medication advice
Emergency medical care
Professional healthcare services

The tracker is not intended to replace care from a qualified healthcare professional.

Customers should contact an appropriate healthcare professional regarding symptoms, diagnosis, medication, treatment, or other medical concerns.

If you believe you are experiencing a medical emergency, seek appropriate emergency medical assistance.

19. PRIVATE TRACKER INFORMATION

Information that a member privately enters into the SRC Lupus Wellness Tracker™, including wellness entries, symptoms, medications, appointment notes, personal notes, and related wellness information, is governed by our Privacy Policy.

Private tracker entries are not treated as public website submissions, reviews, testimonials, or marketing content merely because they are entered into the tracker.

We do not claim a marketing license to privately entered wellness information merely because a member uses the tracker.

Please review our Privacy Policy for additional information about privacy and data practices.

20. REVIEWS, TESTIMONIALS AND PUBLIC SUBMISSIONS

If you voluntarily submit a review, testimonial, social-media comment, photograph, product feedback, or other material specifically for public display or promotional consideration, you represent that you have the right to submit that material.

Where you expressly authorize us to publish or share such content, you grant She-Rise Collections a non-exclusive right to use the submitted material for the authorized purpose.

Private customer-support messages and private wellness-tracker entries are not considered public submissions solely because they are communicated to or stored through our services.

21. INTELLECTUAL PROPERTY

Unless otherwise stated, She-Rise Collections, LLC owns or lawfully uses the content associated with its website, branding, original graphics, digital products, AI generators, prompt systems, web-based tools, product designs, written content, membership materials, and proprietary systems.

Protected materials may not be copied, reproduced, reverse engineered, redistributed, resold, republished, or commercially exploited except as expressly permitted by the applicable product license or law.

22. PROHIBITED USE

You may not use our website, products, memberships, or digital systems to:

Commit fraud
Violate applicable law
Attempt unauthorized account access
Circumvent membership or access controls
Distribute malware or malicious code
Interfere with website functionality
Steal or scrape proprietary content
Redistribute protected digital content without authorization
Infringe intellectual-property rights
Impersonate another person

24. AFFILIATE LINKS AND THIRD-PARTY RECOMMENDATIONS

She-Rise Collections may participate in affiliate or referral programs.

Some links on our website, social-media channels, emails, or other content may be affiliate links.

We may receive a commission or other compensation when a qualifying purchase is made through certain affiliate links, at no additional cost to the purchaser unless otherwise disclosed.

Participation in an affiliate program does not mean we control the third-party merchant or its products, fulfillment, pricing, refunds, or policies.

25. PRODUCT AVAILABILITY AND CHANGES

Products and services may be added, updated, replaced, suspended, or discontinued.

We may update digital products, applications, generators, or membership features over time.

We do not guarantee that every feature or product will remain available indefinitely.

Where applicable, material changes to paid recurring services will be handled in accordance with applicable law and required notices.

26. RETURNS, REFUNDS AND CANCELLATIONS

Returns, exchanges, refunds, and cancellations are governed by the applicable:

If a conflict exists between a general provision in these Terms and a more specific product or membership policy, the more specific policy will generally control for that issue.

27. DISCLAIMER OF WARRANTIES

We make reasonable efforts to provide accurate and functional products and services, but we do not guarantee uninterrupted, error-free, or completely secure operation.

Nothing in this section limits warranties or consumer protections that cannot legally be excluded.

28. LIMITATION OF LIABILITY

To the extent permitted by applicable law, She-Rise Collections, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of our website or products.

Internet interruptions
Device incompatibility
Customer failure to maintain account security
Customer failure to review product requirements
Improper use of digital products
AI-platform output differences

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

29. INDEMNIFICATION

To the extent permitted by law, you agree to be responsible for losses or claims resulting from your unlawful misuse of our website, infringement of another party’s rights, unauthorized redistribution of our protected materials, or material violation of these Terms.

30. PRIVACY

Use of personal information is governed by our Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference.

31. GOVERNING LAW

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

To the extent legally permitted, disputes relating to these Terms or use of our services may be brought in an appropriate court with jurisdiction in or serving St. Mary Parish, Louisiana.

Nothing in this provision removes consumer rights or jurisdictional protections that cannot legally be waived.

32. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

33. NO WAIVER

Failure to enforce a provision of these Terms on one occasion does not necessarily waive the right to enforce that provision later.

We may update these Terms to reflect changes in:
